Attorney General sets up DOJ AI Litigation Task Force to challenge state AI laws

ProgrammeGovernmentUS US-COConfirmed

An Attorney General memo created a task force, chaired by the AG with the Associate AG as vice chair and drawing on the Solicitor General's office and Civil Division, to identify and sue over state AI laws seen as burdening interstate commerce or preempted by federal rules. On 24 April 2026 DOJ intervened in xAI's suit against Colorado's AI Act, arguing the law's disparate-impact duties violate equal protection.

Why it matters

The federal government is now a litigant against state AI rules, raising the legal risk that state compliance regimes are paused or struck down.
